I had company property In my car Was bringing it to my work site. I Forgot I had work equipment on me still and didnt realize till I was already at my other work site. Well They had me on camera using it like usual. The next day Before I could turn it in they had another employee search My Car for it and bring it to the Account Managers office thus getting their equipment back and Terminating me for Theft. SO my question is. Did they have the Legal Authority to have another Employee search my Vehicle without my Consent or Knowing so? A friend Said They had No legal Grounds and something about sueing which sounds kinda Stupid which is why im asking on here.

Did they have the keys to your car? If so, why? Did they break into your car to search it? Did you sign any employment agreement about searches (when they can be conducted and by whom?) There's obviously more to the story, and the details would determine whether or not a lawsuit would be productive. The best way to find out is to talk to a real lawyer in person and present them with all the facts and documentation.

Most Employers would have obtained your consent to a search when you joined the company ... so what did you sign when you started ?

im no lawyer but it doesnt sound right to me. sure they could fire you no problem for "theft" whether it was an accident or not. but if what they did is illegal or not they still shouldnt have sent someone to search your car. id ask a lawyer.
